The land of the Otamatea Eco Village is about 250 acres (100 ha) in total and was purchased by a company (Otamatea Ltd.) to be developed into an eco village in 1997.

Resource Consent

We have obtained resource consent from the Kaipara District Council to have fifteen separate lots each with two house sites.

Otamatea Limited

The company is the land developer and transfers titles of unsold lots to the purchasers. It will probably be discontinued as now all units are sold.

Joining/Purchase

Purchasers must familiarise themselves with the vision statement, the covenants and the company constitution. We encourage new members to get to know us first, meet the residents and attend a number of meetings, workings bees and/or social events before purchasing. Purchasers sign a sale and purchase agreement and a memorandum of encumbrance. Purchasers become shareholders and appoint one director per lot in the company.

Titles

Each lot consists of 5 acres (2 ha) of land to which the owner receives a freehold title. The remaining land of about 175 acres (70 ha) is owned and managed in common. Resource consent allows for two main dwellings per block plus a number of accessory buildings. Our agreements relating to land use are registered as covenants on the titles. Our agreements not relating to land use (e.g. joining, leaving, decision making etc.) are documented in the company constitution. Becoming a shareholder/director of the company requires the purchaser to abide by the company constitution. The "Memorandum of Encumbrance" links the covenants and the company constitution in a legal sense.

Selling a Lot

Land and shares can only be sold together. The purchase price is to be agreed between the vendor and the approved purchaser.
